The Minister of National Education, Preschool Education, and Sports, Mohamed Saad Berrada, stated that he submitted his resignation from all the companies in which he was a shareholder, in complete compliance with the applicable laws. This was on October 23, 2024. He confirmed that these resignations were documented on October 24, 2024, with the public authorities in Casablanca.
Berada explained that he informed the board of directors and its members of his resignation without notice from his positions as a managing member in the boards of the two concerned companies. He called on them to take the necessary actions with the relevant authorities.
In a clarifying statement in response to recent discussions regarding his involvement in suspicions of violating the regulatory law related to government work, Minister Berada stated that his resignation is effective and all its legal consequences follow immediately upon submission to the company, according to a document with a fixed date registered with the local authorities of Casablanca on October 24, 2024.
The statement, of which “Tanja7” received a copy, indicated that registering the resignation in the commercial register serves only as a means of public disclosure to third parties dealing with the company, and it is not a condition for the effectiveness of the resignation. The act of registration in the commercial register is a revealing event rather than an event that creates the legal consequences of resignation from the company’s management bodies.
The statement also referred to the regulatory law regarding the organization and management of government work and the legal status of its members, which explicitly excludes companies whose social purpose is limited to acquiring shares in capital or managing transferable values from the cases of incompatibility applicable to government members.
Article 33 states that “members of the government must refrain from engaging in any professional or commercial activity in the private sector for the duration of their duties, particularly their participation in management or administration of private entities aimed at profit. In general, any activity that may lead to a conflict of interest, except for activities that are limited to acquiring shares in capital and managing transferable values.”
Minister Mohamed Saad Berrada emphasized that the company in question is BIP Partners. Despite the exception granted by Article 33 for this type of company, he has submitted his resignation from it.
In light of all the aforementioned data, Berrada concluded that as a member of the government and Minister of National Education, Preschool Education, and Sports, he performs his governmental duties in complete respect of all the legal procedures governing his work.
On the occasion of this clarifying statement, the minister reiterated his firm and continuous commitment to informing the public in accordance with the principles of transparency and accountability. This is to avert all attempts to mislead public opinion.
