The administrative appellate court ruled to compel the company “Amandis” – entrusted with managing water, electricity, and liquid sanitation services – to pay a substantial financial compensation amounting to 11 billion and 300 million centimes (113 million dirhams) in favor of a contracting company that was tasked with executing structural infrastructure works in the regions of Tangier, Asilah, Tetouan, Al-Fahs Anjera, and Fnideq.
The appellate ruling, according to “Assabah” , came to raise the compensation ruled in the first instance by the administrative court in Rabat from only 330 million centimes to 113 million dirhams, an increase exceeding 34 times, based on a mathematical expertise conducted by a judicial expert appointed by the court.
The case dates back to a dispute over six public contracts executed between 2009 and 2015, but both parties – the contracting company and “Amandis” – had signed on June 12, 2016, a comprehensive and final settlement protocol, ending all disputes related to these contracts.
Article four of the protocol includes an explicit and final waiver, non-reversible by the plaintiff company, of any future judicial or arbitration follow-up regarding these contracts, with an official acknowledgment of having received all its financial dues from “Amandis”.
Heavy Financial Implications for the Tangier Municipality
The compensation to be paid will come from the budget of the delegated authority, namely the Tangier municipality, at a time when the city is suffering from increasing financial pressures, especially with the massive bills presented annually by “Amandis”, which exceeded 11 billion centimes in one year according to previous reports.
This case comes in the context of rising tensions between the municipality and “Amandis” as the end of the delegated management contract approaches, where the government announced the establishment of a multi-service regional company that will gradually replace the French company.
